Wemarto GmbH is pleased about your visit and your interest in our company. We know that the careful handling of your personal information is important to you, and we observe the statutory provisions for the protection of your data.

3. Collection and processing of data

3.1 Server log

When you access our website, the following data is automatically collected and stored:

• Domain name or IP address
• Date and time of the server request
• File name and URL accessed
• Access status / HTTP status code
• Referrer URL
• Browser, operating system, language and version of the browser software

The legal basis is Art. 6(1)(1)(f) GDPR. The data is stored separately from other data and is not linked to it.

Personal data that you provide via the contact form or by email is used exclusively to answer your inquiry. The legal basis is Art. 6(1)(1)(f) or (b) GDPR.

3.3 Online shop

Registration is required to use our online shop. The personal data collected (name, email, address, phone) is used exclusively to process orders. The legal basis is Art. 6(1)(1)(b) GDPR.

3.4 Cookies

We use transient session cookies that are necessary for the functioning of the website and the online shop. These are deleted when the browser is closed. You can disable cookies in your browser settings.

4. Storage period

Server log data is stored for 7 days. Data from contractual relationships is retained for up to 10 years in accordance with commercial and tax retention obligations.

5. Data security

All systems are password-protected and accessible only to a limited group of people. Data transmission is encrypted (SSL). Processing takes place exclusively in Germany.

6. Disclosure of data

We do not pass on your data to third parties, except to payment and shipping service providers for order processing and where legally required. The legal basis is Art. 6(1)(1)(f) or (b) GDPR.

General Terms and Conditions

General terms of delivery and sale of Wemarto GmbH · July 2026 edition

1. Scope

These GTC apply to all deliveries by Wemarto GmbH. Individual written agreements take precedence over these GTC. Wemarto GmbH does not recognise conflicting terms of the customer unless expressly agreed in writing.

2. Offers and conclusion of contract

Catalogue details, prices and technical information are binding. Written offers are valid for 30 days. Offers by fax or email are equivalent to written offers. For special manufacture, the customer must accept quantity deviations of up to 10%.

The minimum order value is €50.00 net.

3. Prices

All prices are net in euros, plus statutory VAT, without deductions. Freight costs (packaging, transport) are not included unless otherwise stated in clause 6.

4. Payment terms

Invoices are due within 30 days of the invoice date. After the payment deadline, the customer is in default without a reminder. Default interest is 8 percentage points p.a. above the base rate.

5. Retention of title

Wemarto GmbH retains title to the contract products until all payments arising from the business relationship have been received in full. The customer is obliged to handle the contract products with care and to insure them adequately.

6. Delivery terms

Deliveries within Germany are carriage paid (free delivery). For deliveries abroad, the customer bears the freight costs (charged according to the DHL international tariff). The place of performance is Wöllstadt. Delivery delays due to external circumstances (force majeure, strike, etc.) release Wemarto GmbH from the delivery obligation for the duration of the disruption.

7. Notice of defects and warranty

The customer must inspect goods without delay in accordance with § 377 HGB and report defects in writing. The limitation period for claims for defects is 12 months from the transfer of risk. In the case of proven defects, Wemarto GmbH has the right to subsequent performance (rectification or replacement delivery).

8. Liability

Liability is limited to intentional or grossly negligent breaches of contract. In the case of simple negligence, liability is limited to the foreseeable, typically occurring damage. Liability for damage to life, body and health and under the Product Liability Act remains unaffected.

9. Confidentiality

Technical documents, drawings and data transmitted within the scope of the business relationship must be treated confidentially and may not be passed on to third parties.

10. Place of jurisdiction and applicable law

The place of jurisdiction is the registered office of Wemarto GmbH (Wöllstadt). German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Delivery information

Shipping Policy

1. General shipping information

We ship EU-wide via our logistics partner DHL. All orders are prepared for shipment within 1–2 working days.

2. Shipping costs

Shipping costs apply to every order and vary depending on the destination country and shipping method. The exact costs are shown during the order process. Additional costs may arise for:

• Express shipping
• Freight forwarding deliveries
• Bulky goods or special packaging requirements

3. Delivery times

• Regular delivery time: 2–3 weeks depending on destination country and availability
• For immediately available stock items, delivery can be faster
• For freight goods, the delivery time may differ

4. Shipping methods

Standard: DHL parcel. Optional: DHL Express or freight forwarding (for large/heavy items). The shipping method is selected automatically or by the customer at checkout.

5. Delivery area

We deliver to all EU member states. No customs formalities arise within the EU.

6. Disclaimer and transfer of risk

Wemarto GmbH is not liable for delivery delays due to external circumstances (strike, force majeure, overload). Transport damage must be reported immediately to the carrier and in writing to us. For consumers, the risk passes on handover to the customer; for business customers, on handover to the transport service provider.

7. Shipping restrictions

• Delivery to a parcel locker is possible, except for freight goods
• Bulky goods are delivered only to the kerbside

Cancellation & returns

Refund Policy

1. General information

These policies apply to all orders from our online shop. Refunds are made via the payment method originally used.

2. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal of 14 days from receipt of the goods. A refund is possible if:

• the withdrawal was declared within 14 days
• the goods are returned undamaged and in their original packaging
• the goods are not subject to an exclusion category (see point 6)

3. Return costs

The customer bears the return costs. Exception: for defective goods or incorrect delivery, we cover the costs. Parcels sent carriage forward cannot be accepted.

3. Return of the goods in original packaging
4. Inspection of the goods in our warehouse
5. Refund within 7–14 working days

5. Defective or incorrectly delivered goods

In the case of damaged, faulty or incorrectly delivered goods, please contact us immediately with photos. In these cases we cover all return costs and arrange replacement or a refund.

6. Exclusion from the right of withdrawal

• Custom-made products and products manufactured to individual customer specifications
• Items that can no longer be restored to their original condition
• Products without original packaging

7. Condition of returned goods

For a full refund, the goods must be returned unused, complete, without signs of use and in their original packaging.
